In Florida, sealing or expunging a criminal record can allow someone to remove or limit public access to records of a criminal case. This can significantly improve a person’s ability to find employment, housing, or educational opportunities.
You may qualify if:
- You have no prior convictions (including misdemeanors).
- Your case was dismissed, nolle prosequi (dropped), acquitted, or you received a withhold of adjudication for a qualifying offense.
- You have never sealed or expunged another case in Florida (only one per lifetime, generally).
You cannot seal or expunge if:
- You were adjudicated guilty of any criminal offense (in this or prior cases).
- You are currently on probation or under court supervision.
How Long Can It Take?
- Generally, FDLE processing can take 3–6 months.
- Generally, the full process may take 6–12 months.
